AYC Frame — Terms of Use

The AYC Frame is provided by AYC Network FZ-LLC (“AYC”), Licence No. 107857, registered under the Dubai Development Authority, Dubai Media City, UAE. By using the AYC Frame you agree to these Terms. They are between you and AYC only, and create no obligation on the venue and no right for you against the venue in respect of the AYC Frame.

1. What AYC Is Not

  • AYC is not the venue. It does not prepare, sell or serve food or drink, set prices or availability, and is not responsible for anything you order or consume.
  • AYC is not an internet service provider or telecommunications operator. The connection is delivered over a network operated by the venue or its internet provider.
  • AYC is not the advertiser. Each advertiser is responsible for the content of its own advertisement and for its compliance with applicable law.
  • AYC is not a bank or a licensed financial institution and does not itself provide payment services. Where payment through the AYC Frame is available, it is processed by a licensed third-party payment provider. AYC does not hold your money and does not collect or store your card details.

2. Using the AYC Frame

The AYC Frame is for your personal, non-commercial use during your visit. You must be 18 years of age or over to give us your details. You must not:

  • access, modify or interfere with the AYC Frame’s software, settings or network connections;
  • access, upload or transmit unlawful, offensive or harmful content, or use the Wi-Fi for any illegal activity;
  • damage, deface, remove or tamper with the device;
  • enter anyone else’s mobile phone number; or
  • use the device for any commercial purpose without AYC’s prior written consent.

We may suspend or withdraw access, including Wi-Fi access, where we reasonably believe these Terms have been breached.

3. Wi-Fi and Ordering

Wi-Fi is provided on a best-efforts basis. AYC does not guarantee connection speed, availability or uninterrupted access. The connection is subject to any acceptable-use terms imposed by the venue or its internet provider and to UAE law, including the laws on cybercrime and prohibited online content. You are responsible for your own activity on the network.

Where a venue offers ordering through the Frame, the order is between you and the venue. AYC passes the order on and is not responsible for what is prepared, how long it takes, what it costs, or anything else about it.

Where payment through the Frame is available, your payment is taken by a licensed third-party payment provider, and your card details are entered with that provider rather than with AYC. What you are buying remains a contract between you and the venue. Refunds, incorrect charges and any dispute about your order are matters for the venue; we will pass on a request but cannot resolve it ourselves.

4. Advertising

The AYC Frame displays third-party advertising during passive moments. AYC selects which advertisers appear and applies content standards, but responsibility for the content of an individual advertisement and its compliance with applicable law rests with the advertiser. Advertising is not an endorsement by AYC or the venue. Advertising is not targeted at you personally, and advertisers do not receive your personal information.

Where an advertisement invites you to take up a sponsored offer, we tell you at that point what will be shared and with whom. Nothing is shared unless you choose to accept the offer, and declining it does not affect anything else on the AYC Frame.

5. Reviews

You may be invited to rate your visit and then offered two options: send private feedback to the venue, or leave a public review on Google. Both are offered to every guest whatever they rate. Leaving a review is your choice, its content is yours alone, and no reward or incentive is offered for leaving one. Reviews on Google are governed by Google’s own terms, and AYC does not see, receive or store them.

6. Your Data

What we collect and why is set out in our Privacy Notice, available on this device and at www.aycnetwork.com/privacy. When you first give us your details you agree to these Terms and that Notice, which includes the venue and AYC contacting you with offers and promotions. You can withdraw that agreement at any time by emailing privacy@aycnetwork.com. You must be 18 years of age or over to use the AYC Frame.

7. Intellectual Property

The software, interface design and AYC branding on the AYC Frame are owned by AYC or its licensors. Menu content and the venue’s brand material remain the property of the venue or its licensors. You may not copy, reproduce or distribute any content from the AYC Frame without prior written permission.

8. Limitation of Liability

The AYC Frame is provided “as is”. AYC does not warrant that it will be free from errors or interruptions. To the fullest extent permitted by UAE law, AYC is not liable for indirect or consequential loss or loss of profit, and in particular is not liable for interruption or unavailability of Wi-Fi, or for your reliance on menu information, prices or availability, which are provided by the venue. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded under UAE law, or affects your rights under the PDPL.

9. General

These Terms are governed by the laws of the UAE and are subject to the non-exclusive jurisdiction of the UAE courts. AYC may update these Terms, and the current version is always available on the AYC Frame and at www.aycnetwork.com/terms; where a change materially affects how we handle information you have already given us, we will ask for your consent again rather than rely on your continued use. If any part of these Terms is unenforceable, the rest continues to apply. These Terms and the Privacy Notice are the whole agreement between you and AYC in relation to your use of the AYC Frame.
